Newark, OH asked in Landlord - Tenant for Ohio

Q: Ohio. may i withhold rent? no rental agreement signed. Landlord (LL) owns 3 units, to my knowledge.

Out-of-state landlord (LL) was advised ~end of Feb, 2021 of leaking water in basement. This is apparently sewage pipe backup as significant blackwater in basement - odor comes through hot air vents causing health issues.

Regular plumber came, did initial assessment, then never returned. Would not return texts.

I gave LL name of 2nd plumber (Hesson) who came & gave LL estimate. I followed up w/plumber #2, as he did not return as scheduled: he said he was 'overwhelmed w/work'. He would not even estimate a start date. I advised LL; gave LL 3rd plumber (Gutridge). LL asked if 3rd more expensive. LL contacted 2nd plumber again.

Gave name of 4th plumber (Cruikshank) to another tenant to follow up. LL has not replied. As of this morning, May 17, he has not returned my phone calls, or that of the other tenant.

A: I would suggest speaking with a landlord tenant attorney in person for a full consultation before you take such actions. You are essentially arguing for a constructive eviction due to the condition of the property.
