Q: Trafficking a controlled substance (meth> 2g) 1st deg. 1st offense, with a persistent felony offender1 in KY jail time

More than 2 grams. Just curious how much jail time we're looking at.

A: Persistent felony offender enhances offenses up to two levels. A lot of times you can negotiate a plea deal and get rid of the persistent offender in exchange for plea of guilty. The big hammer with persistent felony offender in the first degree is that some offenses turn into mandatory 10 years to serve.

A: Trafficking in meth is a class D felony carrying 1-5 years. The PFO 1st bumps it up to levels to a class B felony carrying 19-20 years.
