Q: Buenas tardes Quiero saber que tipo de delito es un fraude cometido por un particular a una dependencia Municipal.

Se trata de un Proveedor al que cierto artículos se pagaban el concretar la negociación y este facturaba al recibir el comprobante de la transferencia, generalmente todo se cumplía de acuerdo a lo convenido hasta que en diciembre 2020 se negocio un compra y se le pago cerca $240,000.00. Como era costumbre nos envión las facturas y unos contratos firmados y escaneados al igual que su identificación oficial pero la mercancía nunca la envió y ahora no podemos contactarlo pues no responde el celular, ni los mensajes. Hace meses envió unos email disculpándose y prometiendo cumplirnos pero a la fecha no hemos conseguido nada.

Sin embargo, el incumplimiento de contrato no es un delito en la mayoría de las circunstancias. Asimismo, el fraude es una posible causa de acción.
