Q: I filed 12 police reports on my upstairs neighbor for harassment we live in fear. I have video proof. what do I do ?
My upstairs neighbor is making us crazy !! I have filed 12 police reports and the Judge always finds no probable cause. He called the cops on my wife for smoking a cigarette in front of our garage, he had a master switch to my electric garage and waited for my wife to enter then locked her in. he then texted the landlord and myself claiming to be a hero for rescuing her before dying... The guy is a freak with cameras pointing everywhere...He thinks everyone is a drug dealer... The entire neighborhood is tired of him...the landlord knows all about it and does nothing!!
I have a lot of video evidence of him Harassing Us for no reason...We are good people !!!! PLEASE HELP
A: Make an appointment with the County Prosecutor to discuss the problem. Also send a certified letter to the Landlord that you will be paying the monthly rent, in a timely fashion, into an escrow account. The money will not be released until the problem is addressed. The Landlord's recourse is to an action in tenancy court to seek eviction, You must defend that action and explain the problem to the Judge as well as showing the Judge the bank statements proving that you have paid the required rent into that account on a timely basis. The landlord could choose to file suit to collect the unpaid rent. Again, if the Landlord chooses this route, to defend the action and explain the situation to that Judge along with showing timely rental payments.
