Q: I lost temporary custody of my son.he got haircut foster mom, told them he had white poop.hippa violation?
Told whole hair salon his body fat was eating away at his body. So he had white poop. I'm assuming Dr told them that. Even though it's untrue, is that a HIPPA violation? Do I have grounds to sue. Also the foster care agency, denied my mom rights to take my son. The judge luckily ordered him into my mother's home after a 90 day review. The foster care agency denied my mom saying she didn't make enough money which was untrue. They just wanted the foster care agency to keep Lincoln.
A:
HIPPA is largely misunderstood; No, it's not a HIPPA violation for people who are not health care workers to effectively gossip.
Your mom does not have rights to take your son. Relatives have placement priority, but not an absolute right. I am glad to hear your child will now be placed with her, though.
By way of general advice regarding CPS cases, you really need to focus on doing everything (and more) your service plan details. Your reunification with your son depends on it. Your lawyer's job is to make sure the foster care agency is doing right by you; don't get distracted by what they are doing or what other people are doing because at the end of the day, the judge is either going to bring your son home with you or terminate your parental rights based on what YOU did or did not do.
