Q: My sister was hospitalized and released from a hospital in 2018 and had to readmitted the next day and intubated .

When she was released she wasn't suctioned properly and Conti ued to be admitted and released . She asphyxiated on the trache in 2019. Can I sue for wrongful death?

A: In Louisiana, one has a year from the date that he/she knew (or should have known) of the malpractice or, in any case, within three years of the date of the malpractice, to file a request for a review panel with the LA Division of Administration. Considering the facts you've presented, action must be taken immediately to protect any rights you and/or your sister's family may have. Louisiana law would determine who would have a right to pursue any malpractice.
