A: Under most circumstances, the maximum is a class A misdemeanor punishable by up to one-year confinement in county jail and a $4,000 fine. However, if the defendant has a prior conviction for the same offense then it can be charged as a State Jail Felony which is punishable by up to 2 years in State Jail and a fine up to $10,000. These maximums are before any enhancements are applied due to other previous convictions and do not consider the possibility of revocation for any active probation or parole.

The minimum punishment is NOTHING if, for example, the case is dismissed or the defendant is acquitted at trial.
