A: A Petition to Revive a trademark registration application generally must be filed within two months of receipt of the Notice of Abandonment. A new trademark application will likely have to be filed in for such a trademark. However, note that the abandonment of an application does not mean that a trademark is no longer in use by the applicant or any other business. Consult with a trademark attorney to assist you.

A: It might be possible to revive that trademark!

As another attorney mentioned though you better be careful.

Just because the trademark is dead does not mean that they or anyone else is not using the mark.
