Mchenry, IL asked in Immigration Law for Illinois

Q: This person is here in the United States seeking for asylum because in his country he was kidnapped. He is arrested

He is arrested for entering the home of the ex wife and beating up the boyfriend. This person has schrizopenia and PTSD and since he is alone in this county he wasn't taking the medication. He has been hospitalized for this reason. IF he returns to Mexico his life in danger. this is what happen the ex wife left him but then was harassing him and looks like she set him up to go her house an cause this because she is facing deportation. She knows his condition but doesn't help him if anything she instigate for the kids to physical abuse him. The boyfriend of the wife kept harassing him and instigating. He is lake county jail for home invasion, aggravated assault and resist the arrest (I think he was having an episode). Does he has any chance of fighting his case and being deported. He is the one that has full custody of the kids. The kids are also in danger if he they return to Mexico.

A: You presented an asylum case on merits that has collateral procedural history and at the very least a few state criminal charges pending against him (criminal home invasion, criminal trespass, domestic battery or aggravated domestic battery). All of those are crimes of violence and trigger the analysis of Crime of Moral Turpitude.

I suggest discussing the immediate legal strategy with a selected immigration counsel of your choice.
