Q: I have a barn people have been renting for storage and are now 5 months behind on rent. How do I evict them in Ohio?

They have refused to sign a new lease and are on a month to month basis. I notified them Tuesday (8/31/21) that they need to either be current or have all their belongings removed by Friday (9/3/21). Per the lease they have to be current on rent to maintain access to their items.

A: If it is a month to month lease, then either party can give 30 days written notice to terminate the lease at the end of a month. The notice must be specific. Proper notice given on 8/31 would terminate the lease on 9/30. If the tenants are not out 10/1, then landlord must give a written 3-day notice. The local court has a specific form for the 3-day notice. If tenants didn't pay rent, then a 30 day notice is not required, and landlord can give the 3-day notice. If they aren't gone in 3 days, then landlord can file an eviction, and a hearing will be scheduled a few weeks later. If tenants are put out without the proper eviction process, tenants can sue landlord for wrongful eviction.
