Q: My husband was taken into federal custody for violating the conditions of his pretrial release

But i have shown overwhelming proof that he was not in violation and his attorney REFUSES to petition the court reinstate his bond what can i do. They said that he failed to keep in contact but his phone was in the repair shop for a week and he provided them with 2 CONTACT NUMBERS yet they only used 1. He had 4 months of compliance with only 1 missed UA that he promptly made up the next business day. I have sent phone records, receipts, and screenshot of to pretrial providing 2 numbers and his attorney wont do anything

A: Missing a UA is a violation. So is not keeping in contact. Perhaps he has good excuses or explanations but they ARE still violations, no matter how trivial they may seem. Remember that the attorney's primary responsibility is to achieve the best possible ultimate RESULT in the case. Spending hours fixing an easily preventable bond issue is slightly out of bounds... especially when the attorney had no hand in creating the bond mess.

Unfortunately, if the attorney is court-appointed, then there is a decent chance that the attorney suspects that the judge will not pay them for the work required to fix the bond... because that is not the primary responsibility. So, if the attorney is appointed, you may be asking the attorney to VOLUNTEER their time to fix somebody else's mess. If you hired a private attorney then your expectations of customer service can be higher because you can just pay extra for the hours required to fix the mess.
