Q: Is it legal for me to date someone 16 when I'm 21 if we are both age of consent?

Nothing sexual about it

A: If there’s nothing sexual about it, then it’s not dating.

Also, the age of consent in Illinois is 17.

So, definitely a felony.

A state resident under the age of 16 is cannot give a valid consent for any sexual activities of any nature. In fact, the age of consent in Illinois is 17. Thus, that 21 year old is exposing oneself to a variety of possible criminal charges of sexual nature, such as grooming a minor for sexual purposes, criminal sexual assault (rape), stalking a minor for sexual purposes, criminal aggravated sexual battery of a minor, corrupting of a minor, sexual exploitation of a minor for sexual purposes, possession of child pornography of a minor under the age of 18, etc.

The list is not exhaustive and may create a very serious criminal situation with point of no return, EVEN if you think you did nothing wrong and YOU HAD consent from that 16 year old (which is legally defective).

My professional recommendation is to stay away for the above purposes and find another willing participant over the state age of consent.
