Q: IF MARRIED MAN HAS CHILD WITH MISTRESS BUT STAYS WITH HIS WIFE, CAN THE MOTHER OF THE CHILD NOT ALLOW CHILD AROUND WIFE?
The mother of the child will ONLY allow the father to hang out with her and the child. She wants the visits at her home. she wants dinners and hours of fun activities with just the 3 of them. She won't let him pick up the child or do anything with her not being there bc she wants to make sure he doesn't bring the child around the wife. (She still wants him and is trying to use this to make him see that they are a family) She tells him that the child will NEVER be allowed around the wife. He visits once a week for 3/4 hours at a time. What would the odds be in court for him having custody every other weekend with his family.
A: He should consult with an attorney to protect and assert his paternal and custodial rights to the child. If he and the mother cannot agree on the terms of his custody and visitation, he should ask the court to do so. The mother alone does not have the final say.
