Q: If I buy a car from a private licensed dealer and never signed the title. Can I return it if the car is not good?

I purchased a car 3 days ago from a licensed dealer. A week before, I had test drove the car and it was driving perfectly. I had to sell my car in order to have all the cash to pay him which I did last Saturday. As soon as I had the cash, he drove to my location with my new car and I paid him and he handed me the title to sign. He drove himself back to davie which was a 30 min drive. He was driving pretty slow so I asked him why and he told me that he was just cruising. Once he got to davie, he had me sign an as is agreement. Which I later realized had the wrong milage on it. So I was driving myself back home when I realized the car couldn't go any faster, so he lied. Took to my mechanic same night and car's transmission is failing. The next day after almost causing two accident called him and told him that I don't want the car because he misinformed me. He told me thats its final. Thats when I realized that I never signed the title and that the as is agreement had the wrong milage.

A: A contract is enforceable even when it is verbal. Not signing the title does not mean there was not a contract. Your conduct of paying him and getting a car are sufficient proof. You may have other right to get your money back depending on the circumstances and the promises made. There is no way to know unless you talk to a lawyer about it.
