Q: how do I complete probate inventory when decease only asset has been transferred prior to completion of probate proces
my decease mother had a car with loss title. Department of motor vehicle transfers title to decease child instead of issuing a duplicate title
A:
Hello. Great question. The inventory is what the deceased owned at time of death. The auto would be listed on the inventory.
You should consult a local attorney in your area to assist with probate.

A: This situation does not sound correct. Unless the title to the motor vehicle was set to pass through a transfer on death designation, the BMV should not transfer title to anyone else until authorized by the probate court. If the vehicle had a transfer on death beneficiary named, then it should not be subject to probate. I think you need to sit down with a probate attorney to figure out what is going on and what your obligations are. Fixing an incorrect probate case can be difficult and expensive.
