The claim could be dependent on the difference in appearance between the two medications, what medication was actually described on the prescription bottle, how much of the "wrong" medication you took before discovery of the error, and the extent to which you became "sick." Even if negligence occurred and you consumed the wrong medication through no fault of your own, the extent of your actual "damages" might have a bearing on whether a claim is worthy of the time and expense necessary to pursue it!
