Q: If parents have joint custody, can one parent restrict who can pick up and dropoff from school when child is with other?

Mom does NOT want new mistress to be able to pick up or drop off her child while he is with dad. They are fighting for custody now and going through divorce. Court did just order joint custody. Mom is very adament about not having her child with a stranger. Can she even say anything if child is not with her for that week?

A: What does the existing order say, if anything, in regards to a spouse's significant other? If it is not addressed in the existing order and you want it addressed, then bring this issue back to the Court for discussion. That said, before you do this I would speak or consult with a family law attorney in your area and discuss you specific concerns.

A: Yes the Judge can and will say who can pick up and even who should be in child's presence. Neither parent should have girl friend or boy friend around child until divorce final, and parent and love interest have been in an exclusive relationship of at least six months.
