My fiance was arrested on November 25th for Domestic Battery and unlawful restraint and he is not guilty

A: If he is not guilty, then he absolutely has the right to a trial -- either before a judge or a jury. He must have an experienced attorney representing him in this matter as if he is found guilty of domestic battery, he cannot get court supervision and will have a conviction on his record which he can never expunge. These are very serious charges.
