Huntington Beach, CA asked in Criminal Law for California

Q: Will I get drug tested for my first court date after being caught in possession of mushrooms as a minor?

It's my first time having trouble with the law. I was caught in possession of a small amount of psilocybin mushrooms a month ago when I was a minor. I'm an adult now, but I'm not sure if that makes any difference. Will I get drug tested on my court date?

A: It's unclear from your question whether you have a court date for Arraignment set and where. Check the citation or go online on the Orange County Superior Court website and type in your case number.

If charged as an adult, your case will likely be heard at the courthouse in Westminster or perhaps in Newport Beach. If charged as a minor, it would be in Juvenile Court in the city of Orange near the "Orange Crush" where the 5, 22 and 57 freeways meet.

You will likely be offered DEJ (Deferred Entry of Judgement). What that means is that you will be ordered to attend Drug classes usually for 1 year. You will be periodically tested for drugs (not at the Arraignment but after you sign up for the drug classes). If you remain "clean', the charges will be dismissed as if they never happened.

Hope this helps assuage your concerns.

A: does your citation/ticket list the court? Juv Court? the date of the incident controls.

every county is different as is every judge........but I would not think there would be a drug test.

to be safe if you are worried...don't do drugs.
