Denton, TX asked in Criminal Law for Texas

Q: My husband's defense lawyer will not release his case file. What can I do?

My husband, upon poor advice of his lawyer, signed a plea deal for a 15 yr sentence in TDCJ. This lawyer did absolutely nothing in preparation for his case, including only communicating with my husband or myself a total of 3 times. One face to face meeting with my husband before he was even retained, and 2 short phone calls with me. I sent multiple texts, emails, and phone calls asking that he speak with my husband about his case, all to no avail. His lawyer spoke with no expert witnesses on my husband's behalf, nor did he even make any effort at forming some sort of defense strategy. Since my husband has been sentenced I have requested his case file from his lawyer. He has refused and now will not respond to further requests for his file. I am financially and emotionally drained, and I'm wondering what, if any recourse is available to my husband. At the very least, what can I do to get his case file released by this lawyer?

A: Your husband can request a copy of his file.
