Q: My Dad died in June 2021. He supposedly left everything to his brother in his Will. Do I have any rights?
I never received a copy of my Dad's Will. My Dad worked his whole life and did well. My Uncle and his sons had safes, tools, a Harley, and other things cleaned out of my Dad's house before his funeral. My Uncle has been very secretive. He had my sister and I sign a piece of paper that had to be notarized and said it was just to move forward and start the process of everything. I don't know what I signed. He intimidates me. He's supposed to be this Christian man, but he hasn't acted like it. He's told me 5 times that I could have one of my Dad's vehicles, but comes up with an excuse everytime I try to get it. My Dad would've never left his kids and grandkids out. He was a giving man. I've been told that my sister and I are beneficiaries of my Dad's 401K but my Uncle won't even verify that. Is it too late for me to get a lawyer?
A:
There is too much missing information to answer your question. A probate attorney can help you obtain copies of all filings in the probate case and then explain to you what they mean, including anything you may have signed.
Regarding the 401k account, these are employer-based. If you know the employer(s) for whom your dad worked, you can try calling each of their HR departments to advise them that your father has passed. They will probably want a death certificate. That will start the process of getting any death benefits paid and any 401ks disbursed per his last beneficiary designations.
