Q: My 5 year old son got a bad cut on his foot from a sharp carpet tack sticking out. Is apartment management responsible?

He tripped over last night. His wound is approx. 5cm long and 1mm deep on the top of his foot. We took him to urgent care this morning. Doctor did not give any stitches as several hours passed. It will definitely leave scar.

A: The landlord has a legal duty to inspect for any hidden defects prior to you signing the lease and moving in, and would be liable If your landlord failed to remove that dangerous condition. Take plenty of pictures of the defect, and also make sure that your child gets needed medical attention, and if the damages support a lawsuit, then you should retain counsel in the state of Nevada. Based on what you stated, it does not appear that your child suffered any significant damages however.
