Q: How do you remove someone from a deed and car title that you no longer want them on it and they want to contest it.

My dad wants to remove my son from deed and titles. He has had to get a protection order against him. My mom wanted him on the deed and titles. My mom has passed and my dad wants to cut him out of everything.

A: Colorado recognized joint ownership of vehicles. Check with the rules for your county; try typing in the name of your county/state and "joint vehicle registration" for help. At least some counties allow for two types of join ownership, Joint Tenancy With Right of Survivorship (or) Tenancy in Common. JTWROS is the most common because most people use state form DR2395 to title a vehicle in more than one name. It is a safe assumption that your father and your son are on the vehicle title as JTWROS.

You will need both co-owners to sign paperwork to remove a person from a JTWROS vehicle title. Short of a death certificate or a court order there is no way to simply remove someone from an ownership right in a vehicle. The best path forward is to find a way to convince your son to surrender status on the title or convince your father to leave your son on the title. A family counseling service is a great resource to reach a specific goal like this one.
