Q: My son and few other kids were caught with a dab pen in the school parking lot.
Two kids were arrested and my son and another kid was let go. My son had a dab pen that was empty. They said they were waiting on a phone call to see if they were going to take him to jail but they didn't and they didn't even give him a citation or a ticket. Can they still come back with a warrant for his arrest and if so do I need to get a lawyer. He is 17. He has no prior convictions of anything.
A: It would be 100% legal for them to pursue misdemeanor charges for up to 2 years and felony charges for up to 3 years but the likelihood of them actually doing it goes down with each passing day.
