Houston, TX asked in Criminal Law for Texas

Q: If I was detained for a felony but then let go hours later with no consequences, can I have a felony on my record?

I wasn’t given any paperwork, the vehicle used was eventually returned to me after filing a petition.

A: It is possible to be arrested but never charged. In that situation, you could have an arrest record but no case record. Buy a Texas state fingerprint criminal history check from IdentoGO to find out: https://www.identogo.com/services/history-check

I think it costs about $25.

A: If you were never formally charged, and no one ever filed a Felony Information or other accusatory instrument against you, you will NOT have a felony on your record.

If somehow a charge was actually written and filed in a court, you will not have a fcelony conviction on your record, however, there might be a Felony Arrest on your record. If that is true, you should get it Expunged and taken off your otherwise good name.
