Sheridan, WY asked in Criminal Law for Texas

Q: My niece is in Ector County Detention Center an she needs to be emergency release cause her 15yr son is in the hospital

I am her aunt who is trying to help as much as I can but I live in Wyoming. She has been in for over 60days on a drug possession an she has not seen a lawyer an has not been to court. He son had a seizure hit his head an now is in the hospital. She also has a 10yr son. They are both staying with friends right now until she gets out. She was planning on staying for 90 days in hope she would get released but now her son is hurt an they both really need her. She has 2 charges but the first charge the other person involved wants to take that charge so she should not have that charge. She should only have one charge. She needs to get out for her boys.

A: If she has been sentenced to jail then there might not be much you can do. However, if she is being held pending trial then it may be possible to get her released by posting bond (bail.) If I were you, I would try to have a conversation with a criminal defense attorney who has an office in the same city where she is in jail. If you can't reach an attorney, a bail bondsman in the county might be able to help.
