Q: We believe our moving company has committed fraud. We moved from Phoenix, AZ to Granbury, TX.
Our belongs were to be stored in a warehouse in Phoenix for 3 to 4 months while our home was being built in Granbury. We believe the company left our goods in the same trailer (a standard over the road type) for the 4 months before their delivery to Texas. Many items were destroyed & damaged due to the extreme heat in Phoenix & a leak in the trailers roof (the Phoenix area experienced major monsoon rains last summer). Our goods were off loaded from the same type trailer as they were loaded in. We are seeking $15,000 in personal loss & misrepresentation of services rendered. Many of the destroyed items were family heirlooms & mementos of our deceased daughter. We have multiple photos & affected items. The mover is home based in Phoenix, AZ. Do we have case?
A: This sounds more like the basis for a civil lawsuit (contract dispute) that should be filed in Arizona than a criminal case filed in Texas... especially if your goal is to recover monetary damages. Perhaps start by calling an attorney who has an office in the same Arizona county where you previously lived to get a better idea of your options.
