Q: I got a ticket for driving while suspended later when I looked at my ticket I realized the only thing right was my
Name & address. He Wrote the wrong year make model color and license plate #of the vehicle I was driving. Is there a way that I can use that in court to beat the charge?
I was also curious if there is such a thing or law call constructive driving. You know when they can give you a Driving while. suspended ticket for sitting in the driver's seat of a vehicle with no keys anywhere inside
A: Those errors on the ticket would not be fatal to the charge as long as the ticket was given to you and the officer can testify to that. Second if the keys were no where inside the car you could have a defense. Now the question is will the judge buy it and if you have a good lawyer I would say yes as you don't have the ability to drive thus could not have driven while suspended. But be aware people have been convicted for example for driving for DWI purposes even just by walking to their car and never actually getting into it. In this case you are in the car.
