Q: I have been mailed a '90-day Termination for cause qualifying owner reason' notice. We were renting month-to-month.

The owner has stated they want to move back into the property. We have spent 19 months in the property, the last 7 months at an increased rate of rent. Do I still have give a 30 day notice or a shorter time notice of intent to vacate? What are my rights as a tenant if the property owner does not move in but re-rents the property to another tenant? Or if the owner sells the property?

A: Under Oregon law if your landlord as properly served you with a 90 day notice including 3 days for mailing for the reason of moving back into their residence, they do not have another place for your to move to, and you have a month to month residency of which you have been there longer than a year, you have 90 days to vacate the property. Assuming it is proper and you do not vacate by the deadline your landlord can and most likely will file a complaint against you. If you do find out that your landlord does not move into the property as stated in your notice, you would have a year to bring a claim against your former landlord in the court.

If you think that the notice is improper you can talk with a landlord tenant attorney about your claim and what could be your potential next steps if your landlord does not move into the property after you vacate the property as stated in the notice.
