Q: Looking to learn eligibility for either expungement or non-disclosure for charge on 2-6-16. Received 3 years probation.

Need advice on expungement or non-disclosure eligibility

A: Three years probation means it was a felony. If it was regular probation then you are not eligible. If it was a Deferred Adjudication probation that started on 2-6-16 and was completed successfully on 2-6-19 then you may become eligible for nondisclosure on 2-16-24 if you have not had any other convictions or probations since 2-6-16 (except a class C moving violation) and assuming that the charge was not one of those that can never be sealed like murder, human trafficking, injuring or abandoning a child, violation of protection order, stalking, or any offense involving family violence... see government code 411.074 for list of ineligible offenses.
