Q: Hi, I’m currently still represented by an attorney (technically, as the hearing for attorney withdrawal is scheduled for
next week). We had a mediation back in February where the mediator amended the Parental Plan and Marital Settlement Agreement but we ran out of time and didn’t get a chance to sign.
I’ve requested the amended documents from the mediator but he said he doesn’t keep them and that I should contact my attorney.
In the past 2 weeks, I requested them from my attorney approximately 6 times by phone and/or email (or an explanation as to why they can’t be sent) to no avail.
1. For what reason might my attorney not send these amended docs?
2. Should I send a final email AND copy the judge for next week’s hearing in on it or is that a bad idea?
A:
1. It is not humanly possible for me or any other Florida lawyer to tell you why your counsel of record does not respond during his pending motion to withdraw.
2. However, since you recently went through a divorce you must have noticed that your ex did not respond to you during the divorce, right?
3. Put those two very similar situations together to get a clue why your soon-to-be ex-lawyer is not responding.
Note: Before I leave I will tell you why 99% of all lawyers ask for permission to withdraw: They have not been paid.
