Q: I got married over the phone in 2018 in prison I’m in a halfway house trying to get a divorce but

The woman is acting really suspicious and constantly delaying won’t send me the paperwork I keep asking for to get the divorce going. I don’t even know if I’m actually married it was all done over the phone I called her and she three-way called another woman that was supposedly the one that married us. I’ve had people look it up online and they’re saying that that’s not a legal marriage that over the phone is when you’re in prison through the glass on the phones with a minister there with the two of you. I’ve also had someone go online and look up vital records division and no one can find any record of marriage under either one of our names?! I just need to know either way so that I can proceed forward accordingly.

A: Pursuant to Ohio Revised Code 3101.08 describes who can marry people an ordained or licensed minister of any religious society or congregation within this state who is licensed to solemnize marriages, a judge of a county court in accordance with section 1907.18 of the Revised Code, a judge of a municipal court in accordance with section 1901.14 of the Revised Code, a probate judge in accordance with section 2101.27 of the Revised Code, the mayor of a municipal corporation in any county in which such municipal corporation wholly or partly lies, the superintendent of the state school for the deaf, or any religious society in conformity with the rules of its church, may join together as husband and wife any persons who are not prohibited by law from being joined in marriage.
