Q: We were told we have a strong case against a cruise line. Not sure how to proceed.
Contact a local attorney experienced with defamation cases. They are tough cases under Missouri law because you must prove actual damages. Here is a link to the leading Missouri Supreme Court case on defamation.
A: Contact a maritime lawyer immediately. Have them review your contract of carriage (ticket) because, depending on your type of action, there are notice and filing requirements in the ticket that must be complied with, which can be as short as 30 days, and up to one year, from the date of the incident.
A: The best thing you can do is contact an experienced maritime lawyer. Depending on the cruise line, you are required to file any case in a specific location. The vast majority of cruise lines cases must be filed in Miami, Florida (Carnival, Royal, NCL). Princess cases have to be filed in California and Holland America cases have to be filed in Washington State.
