West Babylon, NY asked in Traffic Tickets for New Jersey

Q: Got pulled for speeding no ticket was handed to us. Summon was submitted for our name not our car or license plate.

My husband was driving in New Jersey and got pulled over for speeding (mind you he was doing the same speed limit as everyone else was which was right under 80 in a 65 ) the state trooper took his license check it then came back said thank you she did not hand us any summons we waited there for a minute and then drove away because she didn’t say anything else nor came back to the car

We got letters in the mail from lawyers looking to help us with the careless driving ticket. I call the court to find out information.Turns out that there is a ticket under his name but for a car and a license plate that’s not our car or license plate. We never even owned a car that they’re describing.

The court is saying that we can go to virtual court and explain this but is there going to be more that we’re going to have to do?

Also to add we do not live in NJ. We live in NY

A: In NJ a clerical error like you have will generally, not dismiss the ticket. It may help get a downgrade but even that is not guaranteed and with a lawyer you stand a much better chance. AS long as the ticket was mailed or given to you it will be valid. That being said that may be your defense. I suggest hiring a lawyer, most of us traffic ticket lawyers offer a free in office consultation. I would suggest that you set one up.
