Laurel, MS asked in Traffic Tickets and Criminal Law for Mississippi

Q: If I was given a very vague ticket for posses. with wrong info also , could i have the ticket dismissed ?

was pulled over by a cop who’s known to be dirty. he saw me at gas station, never says a word to me , but as soon as I pull out of parking lot pulls me over. Wasnt even maybe 5 yards from parking lot of store when he pulled me over. Never gave me a reason as to why , or asked me my name or my passengers name , or for my apapers. Automatically just starts searching my vehicle. Never asked for my consent , never told me his reason for doing so. But when I asked only shouted BECAUSE I THINK YOU LOOK HIGH. He gets done & comes back from his car , gives me a ticket for no seatbelt. & posses of controlled sub. However , he didn’t specify what it was he found on my ticket. All it says is schedule 1 OR schedule 2. Doesn’t specify what it was he found. Doesn’t give an amount that was found. Put only N/A under explanation , hair color , phone #, & year & color of car. & ALSO put the wrong zip code & put V6 when the model of my car is not , it’s a G6. Do u think I could have this tket dismissed

A: It is highly unusual for them to not put the controlled substance; however, the information should be further explained in a supplemental report. Your best bet is going to be to get with an experienced criminal defense lawyer to talk about the ins and outs of the case. While the wrong information on a ticket is not unusual, you still have to have official notice of the charges against you in order for it to be a valid notice.
