A: No statute states that. A statute states that each parent is entitled to the child's medical and educational records. ARS 25-403.06.

Rule 49 of the Arizona Family Law Rules of Procedure requires each party disclose the names of any providers for psychological, psychiatric, or substance abuse care. But they are not necessarily required to disclose those records. The other parent can subpoena those records, but the records (1) have some protection by a statute that allows for a psychologist-patient privilege, although that has been ruled to be subordinate to the child's best interests, and (2) can be reviewed by the judge before being released to the other side to ensure only relevant information is released.
