A: There isn't enough information in this question to intelligently answer your question. That would require a review of all the police reports and other evidence that was gathered in your case. But you are charged with a felony and you need an attorney. No ifs ands or buts. Hire your own attorney or get a public defender on board if you cannot afford private counsel.

A: Normally, voluntary intoxication is not a defense to a criminal charge. But it can have an impact on the way a case is viewed. It's important to get a good criminal defense lawyer on your side, looking at the available police reports and videos, after hearing form you about what you know. Then your lawyer will be in a position to identify the best available defense issues, bot pretrial and trial. Bottom line: get help from a criminal defense attorney - either private or public defender.
