Q: I've not reported taxes in 5y (but only made maybe 40k total during that time) Will I go to jail?

-all money was made from Uber

-the majority of it I made this year

A: it is unlikely you will be pursed criminally for missing returns unless something else is going on. However it is possible that the IRS and/or State may file a substitute for return on your behalf. When the IRS and/or State takes this action, they utilize the wage and financial information that has been reported to them from employers (in this case Uber) or other financial institutions. Further, the tax you at the highest tax bracket and will not account for deductions or any credits that you may be due, thus resulting in a high estimation of tax liability on your behalf. Also, if a sub is filed and it does result in liability the IRS can take collection actions (ex: levies, wage garnishments, filing of liens). Filing the original returns for the periods you did not file will help accurately reflect any tax that may be due.
