Q: I have a void felony conviction due to a procedural due process violation

A felony complaint was filed against me as if I was arrested during the commission of an offense but I was not , the felony complaint was then filed with a court my court date was set and I was still not in custody nor was there an arrest warrant out for my arrest .40 days later probable cause was ran on this alleged offense when I became arrested for a different offense.

A: It sounds like you may need to file an expunction. Or sometimes, DPS just messes paperwork out. I would contact a criminal defense lawyer in Texas to straighten this out.
