A: You can prosecute them but there aren’t any damages in the facts you describe to give rise to a civil action.
A: There is a criminal charge for cruelty to animals and you could talk to local law-enforcement about potential charges. I’ve never heard of that being charged when the attempt was unsuccessful but it is possible if you have a good proof. As far as a civil lawsuit you would have to consult a civil lawyer but you could at least get a restraining order against the person that tried to kill your animal.
