Q: Who is at fault for this car accident?

I was driving this morning before it was light out. I was driving and a person came out of nowhere and turned into my lane. I was going the speed limit, and they had just come onto the road, apparently oblivious that I was on the road, they came into my lane right in front of me. I was unable to stop, although I did slow down. I ended up hitting them because I was unable to stop or slow down enough not to hit them. I had the right of way, as I was driving on a road that did not have a stop sign at that intersection. They turned into my lane right in front of me and I had no time to stop. Who is at fault?

A: Complicated question and it depends on the proof that you have. Where was the impact to the rear or to the side of the vehicle? Do you have witnesses? Is there a police report? It could be the other party's fault such as if they failed to yield, or ensure clear path before changing lanes and failing to signal. Was there and injury?
