Dallas, TX asked in Real Estate Law and Civil Litigation for Texas

Q: I need a lawyer to Sue Yes Communities or help us get out of our mortgage. What kind of Attorney do I need?

We have a mortgage but rent the lot. The office manager and her staff harassed my 14 year old son and then the office manager put her hands on him shoving him from behind. I would to Sue and if we can't then get out of my mortgage somehow so we are able to move and buy a house else where. I'm stressed everyday waking up wondering about retaliation. We did get sheriff involved, filed reports and it was approved and sent to CID. I reached out multiple times to Corperate over the last three days and just now got a message on Facebook that they can not speak to me and their legal team is handling it. I need help and don't know where to turn

A: The way to handle your situation is to get a good lawyer who has litigation experience and real estate experience.

I would need to know more about your mortgage to advise you on that.

If you are paying rent on the lot where your trailer home is, the contract will tell you most of your rights and responsibilities.

You need to figure out if you want to sue for assault and battery on your child. Then figure out if the managing company for the lot has violated the terms of the agreement. If so, you might be able to sue for a breach of contract. There are a lot of questions that need to be answered before you can know exactly what type of lawsuit you have available.

Good luck!

A: I am getting ready to work on a case similar to this. It is likely that I will be suing a school for impropriate actions against a child. Regarding the mortgage, I will need to read the terms of your agreement to provide advice.
