Q: Can I sue Ky child support enforcement for keeping warrants active against me long after it was paid?
50/50 custody since may 2022, no cs obligations since, arrears at 0. Was pulled over for a moving violation a couple days ago. Much to my surprise the officer informed me of an old child support warrant in the amount of 1300, from 2019. He had to arrest me, I had to go to jail until the amount was paid or 14 days in the can. This warrant had been satisfied in 2019 but still active. So instead of coming home to my family after work I'm getting booked, stamped like some kind of criminal with mugshots, fingerprints and a concrete floor. Is this not a criminal act? Isn't this injustice? Had not been for my wife's poise to get the money together I'd likely still be there as I am 1 of 70% of americans who don't have that kind of money in a jar at home. This is kidnapping, it's assault, this is slander, and criminal neglect. Please tell me I can sue in a big way. Thank you for reading my concerns and hope to hear from you soon.
A: You may have a claim against them although there are immunity issues involved. Find a civil rights attorney who can evaluate the case for you.
