Q: In Texas, can a homeowner sell their home and then rent it out from the new owner (without ever vacating?).

The new buyer would be an out-of-state family member as well.

A: In Texas, a person can enter into any contract with another person or business, as long as it is not a crime or otherwise illegal.

Here, when you sell your house to a Buyer, that Buyer, can then rent the house out to you (Seller).

You can enter into any terms you want, including allowing the seller to keep his/her furniture and personal property at the house. I hope this answers your question.

Be sure to have an experienced attorney draft and close out the sale and the rental lease. It is not expensive to use a lawyer for a house closing. Most lawyers will charge between $1200-$2500 to manage and execute a "Closing" for the sale of a house and property.

Be sure to have the utilities listed, and manage the name changes, for all home services ASAP.
