Woodburn, OR asked in Products Liability for Oregon

Q: Am I at risk of a lawsuit against me if a child chews on and swallows small magnets in my handcrafted items?

I'm creating and selling some handcrafted items which contain small magnets - which are sealed inside my product. I am NOT marketing my product as a toy for small children - but okay for older kids and adults. Would I be at risk for a lawsuit if a child chews on my product and swallows the magnets possibly resulting in injury or death? I AM putting a very strong warning in my packaging just like toy manufacturers do. Will that be enough to protect me or is there something more I should do? Thank you for your response.

A: An Oregon attorney could advise best, but your question remains open for a week. With the warning, you are addressing one of the sources of liability for a lawsuit based on product liability. However, ultimately, there is no controlling whether or not a claimant might sue. Good luck
