Q: Filed probation violation arrest warrant in wrong court?
My husband was picked up on probation violation. He case was originally assigned to division 1 in circuit Court but without any reason or notification, probation and parole filed the violation in division 2. This is in kentucky. Are they allowed to switch courts like that in the middle of case procedure?
A: Although it is not normally done, they can do that if the judge has a conflict or necessary reason.
