Q: In Bell County, Texas what form do I need to file for contempt of disobeying the divorce decree and realtor contract?
My ex spouse moved back into the house instead of getting his belongings out of the house. We are in the middle of a binding contract with our realtor signed by him and I. I have exclusive rights to the house until the house is sold. I have already moved my things out per court order and realtor contract. We have clients waiting to see the house and since he moved in when he was not supposed to, now he is holding up the sale of the house and the realtor can not show the house due to liability reasons. He is tearing up the house which states in the divorce decree he is not allowed to do. The realtor even advised him to stop the construction on the house and to leave the premises so that we can get clients in to look at it and he refused and told the realtor he is not selling the house. The divorce decree states that we are to sell the house and split 50/50. He was supposed to move his things out no later than July 30, 2022. Our divorce was finalized and judgement was 10/26/2022.
