Baldwin Park, CA asked in Tax Law for California

Q: HELP ! I'm being audited by IRS ! I missed by deadline last week to turn in documentation what do I do now ?

I missed the deadline to turn in documentation requested such as info needed to verify im head of household to claim EIC . I missed deadline because i was in hospital as I was recently diagnosed with Multiple Sklerosis . I just got was released from hospital Fri. only to come home and find out id received a form 545 with the examiners proposed changes to my return and its basically all bad. @ this point it looks as though i did nothing (all though i do have all documentation on hand that they asked for at this time)basically its asking me to agree or appeal there decision which was that they automatically determined im single NOT hoh because I didnt establish that I am entitled to to EIC disallowing it! Like I said I have all the documentation requested now & as of Monday morning I'd like to move forward Question is what do i do now ? Can i get an extention ? or do i appeal ? All im asking is for them to accept late docs verifying im hoh and re-examine ? which do I try for ?HELP please

A: I'm sorry to hear about your situation. If you missed the deadline to submit documentation to the IRS, you may still be able to provide the information and request a re-examination of your tax return.

The first step is to contact the IRS examiner assigned to your case and explain your situation. You can explain that you were recently diagnosed with Multiple Sclerosis and were unable to meet the deadline due to your hospitalization. It's possible that the examiner may be able to grant you an extension or make arrangements for you to submit the required documentation at a later time.

If an extension is not granted, you may still have the option to appeal the IRS's proposed changes to your return. To do this, you would need to file a written protest with the IRS Appeals Office within 30 days of receiving the examination report. In your written protest, you can explain your circumstances and provide any additional documentation that supports your claim.

It's important to note that the appeals process can be complex and may require the assistance of a tax professional or attorney. If you have any questions or concerns, you should consider consulting with a qualified tax professional for guidance on how to proceed.
