Everett, MA asked in Child Custody and Family Law for New York

Q: How would my boyfriend go about trying to get custody of his two daughters he has with his ex wife

She has residential custody but they share responsibility for every other aspect pertaining to his kids..before eastet their oldest daughter who is 11 came and told us how the mother whipped her with a belt and left a mark and the mother basically bragged about it later that night to both of us..cps report was made and since then a false report was made against him alleging he beat and broke a wooden paddle on his 7 yr olds behind on a weekend that she was not even here..tonight his 11 yr old called crying hysterically and asked him to come get her because her mother hit and punched her in the mouth.. cops were called and they went out and said that legally she can punish her daughter that way..the mother's boyfriend has messaged him telling him what happened to his daughter and basically suggesting he go to family court tomorrow to try to get temp custody..we cannot afford a lawyer and he has had bad luck with legal aid lawyers..please help

A: He has to file a petition to modify custody. Contact a family law attorney.
