Q: Can a Sheriff's Office be held liable for not following a courts signed order? order to detain re evaluation
A female was having new onset mania-fleeting thoughts, episode was believed to have been brought on by antidepressant (paxil) prescribed by female's dr for symptoms of anxiety (no mental health, bi-polar, manic, etc diagnosis by any dr to include the prescriber). Order to detain said female for evaluation was granted by the court, taken to the sheriff's office. The deputy did not follow the order, female was allowed to be transported by her husband to the mental health facility, into the mental health facility and then walked female back our of the facility to his car. The female has yet to receive medical or mental treatment for this issue. because the sheriff's office did not follow the judge's/court order. The evaluation was influenced by female's husband who per the courts should not have been allowed at the location.

If the patient ended up hurt, or hurting someone else, there may be a viable case.
Due to the nature of lawsuits, the extent of injuries may effect the viability of a case.
